1. About us and these terms

These terms apply to every order placed through br8creations.co.uk, for all current and future products. Please read them before ordering. By placing an order, you agree to them.

Consumers and business customers

If you buy as a consumer, you have legal rights that these terms do not reduce. Some sections apply differently to business customers, and these are marked.

These terms should be read with our Delivery, Returns & Refunds Policy and our Privacy Policy. If there is any conflict on delivery or returns, the Delivery, Returns & Refunds Policy applies.

2. Ordering, prices and payment

A contract is formed when we email you to confirm your order has been accepted.

Placing an order

  1. When you place an order, we send an email acknowledging it. This is not yet acceptance.
  2. We accept your order by emailing a confirmation, or by dispatching the item, whichever comes first.
  3. We may decline an order, for example if an item is unavailable, there is a pricing error, or we cannot deliver to your address. If we decline after taking payment, we refund you in full.

Prices

  • Prices are in pounds sterling (GBP).
  • Delivery is charged separately at standard Royal Mail rates, shown at checkout before you pay.
  • Prices may change, but changes do not affect orders already confirmed.
  • If we find an obvious pricing error after you order, we will contact you. You can then confirm at the correct price or cancel for a full refund.

Payment

  • Payment is taken in full when you place your order, through the payment methods shown at checkout.
  • We do not store your full card details. Payments are processed securely by our payment provider.
  • Business customers paying on invoice must pay within the terms stated on the invoice.

3. Our products

Most products are 3D printed and hand-finished to order in the UK, so each piece is slightly unique.

  • Natural variation: small differences in colour, texture, finish and fine layer lines are a normal part of 3D printing and hand-finishing. They are not defects.
  • Images: we aim to show products accurately. Some images, including promotional and lifestyle images, are illustrative. Colours can also look different on different screens.
  • Sizes: stated dimensions are approximate and may vary by a few millimetres.
  • Safety and use: please read the safety, care and age information on each product page and with the product. Products described as decorative are not toys and are not suitable for children under 14 unless stated otherwise.
  • Materials: most products are made from PLA plastic, which can soften or deform in heat. Keep products away from heat sources and direct sunlight unless the product page says otherwise.
  • Availability: products and offers are subject to availability. Limited-time offers and free gifts last while stocks last, as stated on the product page.

4. Custom orders, commissions and services

Custom products and design, CAD or 3D printing services are made to your specification and governed by your written quotation, as well as these terms.

Quotations

  • Each quotation sets out the work, price, timescale and any deposit. It is valid for 30 days unless it states otherwise.
  • Work starts once you accept the quotation in writing and pay any deposit due.
  • Changes you request after acceptance may affect the price and timescale. We will agree these with you before going ahead.

Approvals

  • Where we send you designs, renders or samples to approve, please check them carefully. We make the final item according to what you approve.
  • Errors in details you supplied or approved (such as names, spelling, dimensions or colours) are not faults on our part.

Designs and material you supply

  • By sending us a design, logo, image, file or other material, you confirm you own it or have permission to use it, and that making the item will not infringe anyone else's rights.
  • We may refuse any work that we reasonably believe infringes intellectual property, or that is unlawful, offensive or unsafe.
  • If a third party makes a claim against us because of material you supplied, you agree to cover the costs we reasonably incur.

Cancelling custom work

Custom-made and personalised items cannot be returned for a change of mind. If you cancel a service after work has started, you pay for the work done up to that point. Full details are in our Delivery, Returns & Refunds Policy.

5. Delivery, returns and your rights

Delivery, cancellation, returns and refunds are covered in full by our Delivery, Returns & Refunds Policy. In summary:

  • We deliver to UK addresses only, charged at standard Royal Mail rates.
  • Most products are made to order and arrive within 5–10 working days.
  • Consumers can cancel most orders within 14 days of receiving them. Return postage is paid by you.
  • Custom-made and personalised items, digital files after download, and completed services cannot be cancelled for a change of mind.
  • Risk in the goods passes to you on delivery. Ownership passes to you once we receive full payment.

Your consumer rights

Under the Consumer Rights Act 2015, products must be as described, fit for purpose and of satisfactory quality. Services must be carried out with reasonable care and skill. If something is wrong, you may be entitled to a repair, replacement, refund or price reduction. For more information, visit Citizens Advice.

6. Intellectual property and digital files

Our product designs, 3D models, images, text and branding belong to Br8 Creations Ltd and may not be copied without our written permission.

  • Our products: buying a product gives you ownership of that physical item only. You may not copy, scan, reproduce or sell copies of our designs.
  • Our website content: product names, photos, descriptions and graphics on this website may not be reused for commercial purposes without our permission.
  • Digital files we sell (such as CAD or STL files): unless your quotation or the product page says otherwise, you receive a personal, non-transferable licence for your own non-commercial use. You may not resell, share or redistribute the files or prints made from them.
  • Commissioned design work: ownership of designs we create for you is set out in your quotation. If the quotation does not say, ownership of the final design passes to you once we receive full payment. We may still show the work in our portfolio unless you ask us not to in writing.
  • Your material: you keep ownership of anything you supply. You give us permission to use it only to complete your order.

7. Our liability

We are responsible for foreseeable loss or damage caused by our breach of these terms or our failure to use reasonable care and skill.

  • What we never exclude: our liability for death or personal injury caused by our negligence, for fraud, or for breaching your legal rights as a consumer.
  • Consumers: we are not responsible for loss that was not foreseeable, or for business losses, as our products are for domestic and private use.
  • Misuse: we are not responsible for damage caused by using a product against its safety, care or use instructions.
  • Business customers: our total liability is limited to the price paid for the order concerned. We are not liable for loss of profit, business, revenue or data, or for indirect losses.

8. Events outside our control

We are not responsible for delays caused by events outside our reasonable control, such as postal disruption, power failures, supplier shortages or severe weather. We will tell you as soon as possible and do what we can to limit the delay. If the delay is significant, you may cancel and receive a refund for anything not delivered.

9. Privacy

We use your personal information only to process your order, deliver it and contact you about it, as set out in our Privacy Policy.

10. Changes to these terms

We may update these terms from time to time. The terms in force when you place your order apply to that order.

11. Law and disputes

  • These terms are governed by the law of England and Wales.
  • Consumers can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
  • If you have a complaint, please email design@br8creations.co.uk first. We aim to reply within 2 working days and to resolve complaints within 14 days.
  • If any part of these terms is found to be unenforceable, the rest remains in force.
